In the article, the author explores the important problem of legal regulation of the status of prisoners of war in the context of modern international humanitarian law. It is stated that international norms are represented by a whole range of specialized general, universal standards, in particular in the Geneva Convention relative to the Treatment of Prisoners of War, the International Covenant on Civil and Political Rights, the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, and the Rome Statute of the International Criminal Court. It is indicated that despite the existence of a fairly wide range of rights of prisoners of war, which are determined by the norms of international and international humanitarian law, the effectiveness of the standards remains controversial. It is summarized that the authors position as a significant positive factor the fact that there are agreed standards for regulating social relations during wartime on a global scale, however, the absence of an effective system of responsibility for their failure to comply causes the collapse, nullity and ineffectiveness of the norms, their declarative nature and lack of guarantees. UN monitoring reports on the situation in Ukraine indicate incredible, especially inhumane actions by both the Russian authorities and society towards prisoners of war, which is especially important to emphasize, since international standards clearly determine that all responsibility for the maintenance and treatment of prisoners of war lies not with private individuals, individual citizens, enemy soldiers, but with the state, in particular Article 12 of the Third Geneva Convention. The main protection of prisoners of war should take place under the auspices of the UN, as the primary, world institution authorized to ensure peace, security and human rights. The international community, including UN institutions at the highest level, calls on the aggressor state to treat it humanely, as well as to apply the institution of prisoner of war exchange. However, the situation of Ukrainian military and civilian prisoners of war is characterized by a total violation of human rights. Torture, humiliation, violence, deprivation of access to basic needs such as food and sleep characterize the behavior of the aggressor state. The ineffectiveness of the UN-based bodies and the lack of effective means of influencing the state holding the prisoners have been noted.
